Residency with Employment Rights Application

To help us process your application as efficiently as possible, please use the checklist below to ensure that all the information we need is provided with your application. If you have any questions concerning what is required, please feel free to telephone the Caymanian Status & Permanent Residency Secretariat on 244-2064.

An applicant must submit the following documentation at the time of applying:

Two completed Application Forms: Please ensure that you have answered each question FULLY and in BLOCK LETTERS

Cover Letter:
We need a letter signed by you and your Caymanian spouse in which you explain clearly the background to your marriage. The letter should be addressed to the Chief Immigration Officer if you are applying for an interim Residency & Employment Rights Certificate, or the Secretary to the Caymanian Status & Permanent Residency Board if you are applying for a full Residency & Employment Rights Certificate. The letter should include details of the circumstances of how and when you met and must also give details of the duration and reasons for any periods of separation during your marriage. Be assured, this information will be treated in the strictest confidence and will only be used by the Chief Immigration Officer or the Caymanian Status and Permanent Residency Board to satisfy itself that your marriage is stable and is not one of convenience. Please note that if the information you provide is insufficient or unclear, or we have further questions, you and your spouse may be requested to attend an interview at the Department of Immigration.
Application Fee:
When you submit your application you will be required to pay a non-refundable processing fee of CI$250.00. If your application is approved, a grant fee of CI$400.00 is payable.
Proof that your spouse is Caymanian:
Please provide proof that your spouse is Caymanian. This can be done as follows:
  1. notarised copy of your spouse's Certificate of the Right to be Caymanian (previously Caymanian Status certificate); or
  2. notarised copy of the letter issued by the Chief Immigration Officer to your spouse acknowledging that he/she possesses the right to be Caymanian (previously Caymanian Status); or
  3. if your spouse was born in the Cayman Islands before 27 March 1977, a notarised copy of their birth certificate; or
  4. if your spouse was born in the Cayman Islands on or after 27 March 1977 and he or she does not possess a letter from the Chief Immigration Officer acknowledging that they possess the right to be Caymanian (previously Caymanian Status), proof that they had at least one Caymanian parent at the time of their birth. This can be done by providing a notarised copy of the Caymanian parent's birth certificate and a notarised copy of the Caymanian parent's marriage certificate (if applicable).
Proof of Identity:
Please provide a copy of the picture page from your passport and that of your Caymanian spouse showing your full names, dates and places of birth.
Medical Questionnaire:
You and your spouse (if applicable) must submit a medical questionnaire that has been completed by yourselves (Part 1) and your physician(s) (Part 2). Click here to download the questionnaire. You must also provide the lab report (original) showing the HIV/VDRL test results. Note: the HIV/VDRL tests must be taken within the six months preceding your application.
Police Clearance Certifcate:
Please provide a signed police clearance certificate from your last place of residence and issued within six months preceding the date of your application. (Note: applicants who are nationals of the United Kingdom and who were resident there prior to coming to the Cayman Islands may submit a sworn affidavit attesting to good character in lieu of a police clearance certificate. United Kingdom nationals who have been living elsewhere must submit a police clearance certificate from that country.
Marriage Certificate/Divorce Decree/Death Certifcate:
Please provide a copy of your marriage certificate. If you were married to another person previously, you must also provide a copy of the marriage certificate and subsequent divorce decree or death certificate as appropriate.
Affidavit
Applicant and spouse must submit evidence of marital stability by completing an affidavit which consists of two parts. Part 1 to be completed by the Non-Caymanian spouse and Part 2 to be completed by the Caymanian spouse. If the parties are separated at the time of submitting the application, but they are still legally married, the applicant must provide a detailed explanation of the circumstances. Birth Certificates:
Please provide notarised copies of birth certificates for yourself, your Caymanian spouse and any children that you are including on this application. If your Caymanian spouse has adopted any of those children, please provide copies of the adoption orders.
Paternity Test:
If you are male, and have included a child or children in your application as dependants and any of those children was born out of wedlock, then you must provide original or certified DNA test results showing you to be the father of the child or children. You must also provide proof that you have full legal custody of the child or children (e.g. notarised copy of the Custody Order).
Evidence of Financial Resources:
  1. Please provide a reference letter from your bank stating the balances of your accounts so that the Chief Immigration Officer or the Caymanian Status & Permanent Residency Board may assess your ability to support yourself and any dependant(s).
  2. If you and/or your spouse are employed, you should enclose a letter from your employer(s) stating how long you have been employed, in what capacity, and your salary. The information you, your bank or your employer provides will be treated in the strictest confidence.
Dependant Details/Information:
  1. Please provide the following information with respect to all children under the age of eighteen that you and your spouse are supporting financially, whether they be children you have jointly or separately:
    • full name
    • certified copy of birth certificate
    • name of school where the child attends
    • name and full contact details of the child's other parent
    • address where the child resides
    • financial details concerning maintenance
    • details concerning visitation arrangements (if any)
    • copy of Court Orders (if any) concerning child support, visitation and custody arrangements.
  2. You must also provide a detailed breakdown of your monthly expenses, i.e. rent/mortgage, utilities, water, bank loans, telephone, school fees. Note: this breakdown must be supported by enclosing copies of bills and rental/mortgage agreement.
Photographs:
Please provide one full face and one profile photograph (passport size) of yourself and each dependant who is included in the application and one full face photograph of your Caymanian Spouse. Print name and date of birth on reverse side of each photograph.

References:
You must provide three written references from persons (not relatives) who have known you for some years.
